Agreement to Terms

By accessing or using ShiftSharks ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Description of Service

ShiftSharks provides volunteer scheduling and event management tools, including:

  • Event creation and task management
  • Volunteer database and scheduling
  • AI-powered schedule generation
  • Automated notifications and reminders
  • Schedule export and reporting

Account Terms

When you create an account, you agree to the following:

  • You must provide accurate, complete, and current information
  • You are responsible for maintaining the security of your account password
  • You are responsible for all activities that occur under your account
  • You must be at least 13 years of age to use the Service
  • Each account is for one person only - shared accounts are not permitted
  • You must notify us immediately of any unauthorized use of your account

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to other users' accounts or data
  • Harass, abuse, or harm other users
  • Use the Service to send spam or unsolicited communications
  • Abuse or excessively use the AI generation features
  • Scrape, spider, or use automated means to access the Service beyond normal use
  • Reverse engineer, decompile, or attempt to extract the source code

Payment Terms

  • Free Tier: Limited usage of core features with usage caps on AI generations and events per month.
  • Pro Tier: Billed monthly via Stripe at the current subscription rate displayed on our pricing page.
  • Price Changes: We may change subscription prices with at least 30 days advance notice.
  • Billing: Subscriptions automatically renew each month unless canceled.
  • Refunds: Refund requests are evaluated on a case-by-case basis. Contact us to discuss refund requests.
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.

Intellectual Property

  • Our Property: ShiftSharks and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws.
  • Your Data: You retain all rights to the event data, volunteer information, and other content you create or upload to the Service.
  • License to Us: By using the Service, you grant us a limited license to use, store, and process your data solely to provide the Service to you.

User Content

  • You are solely responsible for the accuracy and legality of data you upload to the Service
  • You represent that you have the necessary rights to upload volunteer contact information and event data
  • You agree not to upload content that infringes on others' intellectual property rights
  • We reserve the right to remove content that violates these Terms or applicable laws
  • We do not claim ownership of your content, but you grant us permission to use it to operate the Service

Service Availability

  • We strive to provide reliable service but do not guarantee 100% uptime
  • The Service may be temporarily unavailable due to maintenance, updates, or technical issues
  • We may modify, suspend, or discontinue any feature of the Service at any time
  • We will provide reasonable notice for significant changes that affect core functionality
  • We are not liable for any interruption or loss of service

Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind.

To the maximum extent permitted by law:

  • We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not liable for lost profits, data loss, or business interruption
  • Our total liability to you is limited to the amount you paid us in the last 12 months
  • We are not responsible for errors in schedules generated by the AI or user input

Termination

  • By You: You may cancel your account at any time through your account settings or by contacting us.
  • By Us: We may terminate or suspend your account if you violate these Terms or engage in conduct that we determine is harmful to other users or to the Service.
  • Effect of Termination: Upon termination, your right to access and use the Service immediately ends. Data may be deleted according to our retention policies outlined in our Privacy Policy.

Changes to Terms

  • We reserve the right to modify these Terms at any time
  • Material changes will be communicated via email or in-app notification
  • Continued use of the Service after changes constitutes acceptance of the updated Terms
  • If you do not agree to the updated Terms, you should discontinue use of the Service

Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service will first be addressed through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in the appropriate courts.
